O-1 Visa Business Plan
The O-1 Visa for entrepreneurs and individuals with Extraordinary Ability or Achievement is a U.S. nonimmigrant visa. It allows individuals who have demonstrated extraordinary abilities and achievement in the science, art, education, business, sports or in motion picture or television industry and have been recognized nationally or internationally for those achievements to live and work in the United States.
O-1 Visa allows beneficiaries who are approved to remain in the United States for an initial maximum period of up to 3 years or for the duration of the project or employment for which the beneficiary is to go to the United States, whichever is less. USCIS determines the final duration of the visa using the length of the project and the applicant’s involvement to determine its duration. If the project or employment takes longer that the duration of the initial O-1 approval period, it may be extended it in one-year increments. To do that USCIS requires sufficient evidence the beneficiary’s continued presence would be required to complete the project for which he or she was admitted.
Demonstrating extraordinary ability or achievement can be difficult task. It helps demonstrate why a particular applicant is crucial for the success of a US business or a project and how would that enterprise afford paying the applicant.
