EB-5 Visa Business Plan
The United States Green Card through investment can be obtained through the EB-5 Immigrant Investor Program. The EB-5 Immigrant Investor is a U.S. immigrant visa that allows a foreign investor together with their spouses and children to work and live in the United States on a permanent basis.
Currently, an investor that wishes to obtain an EB5 visa is required to invest at minimum $900,000 in a business located in a Target Employment Area (TEA), which is an area with higher unemployment than the average or a minimum of $1,800,000 in any other area. The investment can in the form of a direct investment, actively managed by the investor, or an EB5 regional center that combines the money from multiple investors and manages it on their behalf.
An investor applying trough an EB5 regional center does not need a business plan as the business plan is prepared by the regional center itself. On the other hand, EB5 applicants that wish to make a direct investment and have control over their business are required to submit a comprehensive, detailed and credible business plan that shows clearly the job creation potential of the business and how it will benefit the US economy.
As it is an integral part of any direct investment EB5 application, a business plan must clearly describe the proposed business activity, its location and premises, exactly how the capital will be invested, and how and when new employment will be created. A well-written business plan for EB5 Immigrant Investor must be able to convince the US immigration officer that the new enterprise is likely to succeed in its objectives.
